Cile – L'ANFP ha ordinato ai club di rescindere i contratti con gli operatori di scommesse sportive

The Chilean Ministry of Justice stated that the National Association of Professional Football (ANFP) must tell football clubs that online sports betting is illegal and that as a result they are not permitted to sign contracts with them. 

Talking to local daily El Mercurio, the Undersecretary of Justice, Jaime Gajardo  referred to both the ruling of the Court of Appeals of Santiago ed La corte suprema which ruled against online sports betting operators. Gajardo said that both courts “have been quite clear and agree in pointing out that to operate, online betting houses require legal authorization . . . We are telling the ANFP to inform its partners that online betting houses cannot operate because they do not have legal authorization and that, if they have contracts with these houses, they should leave them void ,” he said.

Although there is no deadline that forces the clubs to dissolve their contracts with these companies, he said that “the clubs must take into consideration that the ruling of the Supreme Court is categorical in saying that these houses operate at the margin of the law . . . Any contract entered into with them is illicit and also marks out not only them, but also those who facilitate the illicit act. If someone had to advise the clubs, he should tell them: ‘Be careful that the Supreme Court has been very clear, not only are these activities prohibited, but the crimes established by the Penal Code can be incurred,’” he said.

In referring to the ruling of the Court of Appeals decision Gajardo said that the government expected the governing body of professional football to comply with the instructions delivered by the Ministry.

“A legal entity cannot contract with them. With that reasoning we hope that ANFP complies with the instructions we gave it,” he said warning that failure could lead to the ANFP losing its legal status.
